Requirements if enacted
- Do not distribute without consentDistribution of qualifying adult material would be prohibited where the proposal’s knowledge, consent, privacy, and harm elements are met.
- Do not threaten distributionIntentional threats to distribute covered material for specified purposes would also be prohibited.
- Special rules for minorsThe proposal applies a distinct intent standard to covered visual depictions of nude minors.
- Recognize statutory exceptionsLegitimate law-enforcement, judicial, medical, scientific, educational, and public-interest activities receive defined treatment.
Proposed criminal penalties
The bill would authorize up to two years’ imprisonment for its adult intimate-depiction offense and up to three years for its offense involving a visual depiction of a nude minor, along with fines. It also provides for criminal forfeiture and restitution.
